Kelly Medina reserves the right to modify this Agreement at any time without giving you prior notice. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Agreement as modified.

USE OF KELLY MEDINA SHOP CONTENT
You may use the Service, the Site, and the information, writings, images and/or other works solely for your non-commercial, personal purposes. No right, title or interest in any Content is transferred to you, whether as a result of downloading such Content or otherwise. Kelly Medina reserves complete title and full intellectual property rights in all Content. Except as expressly authorized by this Agreement, you may not use, alter, copy, distribute, transmit, or derive another work from any Content obtained from the Site or the Service, except as expressly permitted by the Terms of Use.

DIGITAL DESIGN USAGE:
There are 3 options for you to purchase the designs.

NON-PROFIT: Means for personal projects only. You cannot use the designs commercially in any manner.

COMMERCIAL – CREDIT REQUIRED: means you must give credit to Kelly Medina wherever the art is displayed with a clickable link Artwork By Kelly Medina

COMMERCIAL – NO CREDIT REQUIRED: means you don't need to give credit. However,  you will need to pay extra licensing fee for this option (USD $20)

EXCEPTIONS:
Some designs comes with only 2 options: Non-profit and Commercial fee. That means you have to purchase license fee if you want to use the designs for commercial purposes.

LICENSE INFORMATION:

Purchasing the item does not transfer the copyright to you. It means you cannot claim the design as your own design.
This license is non-transferable. Meaning you cannot transfer/ give the license to anyone else, nor can you change the item that it applies to. 
This license does NOT include right for using the design for any mass production. If you wish to do that, you will need to upgrade your license. There will be an additional fee. 
This license is not for paper scrapbook companies. Paper scrapbook companies will require a professional license to use the design. There will be an additional fee. 
For any commercial use,  "Commercial – Credit Required", full credit MUST always be given. If you don't want to give credit, then you need to upgrade your license to the Commercial License – No Credit Required  for USD $20.

How to give credit properly:
1. If you're selling your products online, you will need to create a clickable link Artwork by Kelly Medina

2. To any other media (or website that does not allow you to put web link), you will need to credit to "Copyright Kelly Medina" or "Artwork by Kelly Medina". 

This credit info and/ or link MUST BE placed where ever the art is displayed. 

None of license purchases give you copyrights to artwork or design samples. ALL COPYRIGHTS REMAIN WITH KELLY MEDINA.

WHAT YOU CAN NOT DO:

1. You cannot re-sell, distribute, or give away the original file(s). Also, you cannot add the original design into a CD collection, and then give away/ sell it. You cannot sell any Kelly Medina designs as-is (as set, template, as part of a catalog)
2. You cannot use the design to create a similar commercial digital product that will compete with the original product.
3. You cannot put the original design/image (in a good resolution) on the websites which is easily for others to download or steal it. 
4. Graphics can not be altered or added to and be claimed as your own. 
5. You cannot resell Kelly Medina products as: 
    DIGITAL DOWNLOADS AS IS or ALTERED
    AS CLIPART /ELEMENT SET even its gathered with other elements.
    AS LAYERED TEMPLATE ( where your customer can extract our design)
    CREATING A COLLAGE SHEET FOR ETSY OR ZAZZLE type of websites as same clipart

 

USE OF DOWNLOADABLE PRODUCTS:
Freebies: None of the Kelly Medina freebies posted on MyGrafico is for commercial use.

REFUNDS:
Due to the digital nature of ITEMS, there are NO REFUNDS on items delivered electronically.

DISCOUNTS:

Kelly Medina reserves the right to modify discounts at any time without giving you prior notice. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Agreement as modified.
